1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of the website fragranceandthings.com (the “Site”) and any purchase of products from Fragrance & Things LLC (“Company”, “we”, “us”, “our”). By accessing or using the Site, or by placing an order, you agree to be bound by these Terms. If you do not agree, you must not use the Site.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Site and place orders. By using the Site, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.
3. Accounts & Social Media Login
You may create an account on our Site to manage your orders and preferences. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Our Site also allows you to log in using third-party providers such as Facebook, Google, Twitter/X, or Amazon. By choosing to log in via a third-party provider, you authorize Fragrance & Things LLC to receive account information (such as your name and email address) from that provider solely for authentication, account creation, and account management purposes. You are responsible for maintaining the security of your social login credentials and any activity conducted under your account as a result of that login.
We reserve the right to suspend or terminate your account at our discretion if we suspect fraud, misuse, or violation of these Terms.
4. Products, Pricing & Availability
We make reasonable efforts to display product descriptions, images, and pricing accurately. However, we do not warrant that product information is always complete, current, or error-free. All products and prices are subject to change without notice. We may, in our sole discretion, limit the quantities of products available, discontinue products, or refuse any order.
5. Orders & Acceptance
By placing an order, you are making an offer to purchase products under these Terms. We may accept, decline, or cancel any order at our discretion, including after you have received an order confirmation. If we cancel your order after payment has been processed, we will refund the full amount to your original payment method.
6. Payment
Payment is required at the time you place your order. We accept the payment methods listed on the Site. You represent and warrant that you are authorized to use the payment method provided and that the information is accurate and complete.
7. Shipping, Taxes & Returns
Shipping, taxes, duties, and returns are governed by our separate policies. By placing an order, you agree to our Shipping Policy and Return Policy. We encourage you to review these policies before purchasing.

To the maximum extent permitted by applicable law, Fragrance & Things LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of products, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from or related to your use of the Site or purchase of products shall not exceed the amount you paid for the product(s) giving rise to the claim.

You agree to indemnify, defend, and hold harmless Fragrance & Things LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Site, your breach of these Terms, or your violation of any law or the rights of a third party.
13. Governing Law & Dispute Resolution
These Terms and any disputes arising out of or related to your use of the Site or purchase of products shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles.
Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Atlanta, Georgia, and you hereby consent to the personal jurisdiction and venue of such courts.

We may update these Terms from time to time. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Site after the posting of revised Terms constitutes your acceptance of those changes.
